The general approval of the rules by the bar is gratifying. It is not thought that they are perfect. Amendment will not be difficult when necessity for such amendment appears clear. August 29, 1952. Merrill Associate Justices IN THE SUPREME COURT OF THE STATE OF NEVADA In the Matter of a Study Committee to Review the NEVADA RULES OF CIVIL PROCEDURE. ADKT 276 ORDER AMENDING THE NEVADA RULES OF CIVIL PROCEDURE ________ Whereas, in July 1999, this court appointed an Advisory Committee to study the Nevada Rules of Civil Procedure and to propose amendments or revision; and Whereas, on March 19, 2003, the Committee submitted to this court a report of its activities and recommended specific amendments to the Nevada Rules of Civil Procedure; and Whereas, this court solicited and considered public comment on the recommended amendments; and Whereas, this court has concluded that amendment of the Nevada Rules of Civil Procedure is warranted, accordingly, It Is Hereby Ordered: 1. That the Nevada Rules of Civil Procedure shall be amended and shall read as set forth in Exhibit A. 2. That the Introductory Statement and Forms 3, 19 and 31 of Appendix of Forms to the Nevada Rules of Civil Procedure shall be amended and shall read as set forth in Exhibit B. 3. That a new Form 33 for Consent to Service by Electronic Means Under Rule 5 shall be added to the Appendix of Forms and shall read as set forth in Exhibit B. 4. That these rule amendments shall become effective January 1, 2005, and shall govern all proceedings brought after that date and all further proceedings in actions pending on that date, unless in the opinion of the district court their application in a particular pending action would not be feasible or would work an injustice, in which event the former procedure applies. 5. That the clerk of this court shall cause a notice of entry of this order to be published in the official publication of the State Bar of Nevada. Publication of this order shall be accomplished by the clerk disseminating copies of this order to all subscribers of the advance sheets of the Nevada Reports and all persons and agencies listed in NRS 2.345, and to the executive director of the State Bar of Nevada. The certificate of the clerk of this court as to the accomplishment of the above-described publication of notice of entry and dissemination of this order shall be conclusive evidence of the adoption and publication of the foregoing rule amendments.
